When you request and use a We Buy All Gold and Silver Pack from We Buy All Gold and Silver either by calling us, by obtaining a We Buy All Gold and Silver Pack from any retail establishment or from this website, you, the customer "Customer (s)", hereby agrees to the following terms and conditions:

In order to conduct business with We Buy All Gold and Silver, you acknowledge that you are at least 21 years old. You also acknowledge and attest to the fact that you are the actual legal owner of any and all items submitted to be sold or attempted to be sold to We Buy All Gold and Silver and that you are acting on your own behalf and not as an agent or representative of another individual.

At its discretion, We Buy All Gold and Silver may request proof and/or documentation to verify compliance with the requirements set forth herein.

Guaranty Against Loss

Provided that Customer items are shipped in accordance with the instructions and shipping procedures set forth by We Buy All Gold and Silver, customer's contents will be guaranteed subject to following conditions and to the terms and conditions posted on this website:

• Any package, envelope or other type of mail that appears to be tampered with, damaged or opened may at We Buy All Gold and Silver’s sole discretion be returned by Post Office to Customer. Any such delivery or return of any such items to Customer shall in no way subject We Buy All Gold and Silver to any liability whatsoever.
• Every We Buy All Gold and Silver Pack is insured for $100. IF YOU BELIEVE THAT THE CONTENTS YOU ARE SENDING ARE WORTH MORE, IT IS YOUR RESPONSIBILITY TO PURCHASE ADDITIONAL INSURANCE AT YOUR OWN EXPENSE AND TO USE A CARRIER OF YOUR CHOICE.
• We Buy All Gold and Silver will not be liable for any special, indirect, incidental, consequential, punitive damages, loss of profit or loss of opportunity. Customer agrees that this limitation of liability shall be binding to not only the customer, but also to his successors, assigns, insurance carriers any other person asserting a claim on any material customer submitted to We Buy All Gold and Silver.

By submitting any property to We Buy All Gold and Silver, Customer waives any subrogation claim on his behalf and/or on behalf of his insurance carrier.

Limitations of Liability

By submitting any item to We Buy All Gold and Silver, the Customer acknowledges and accepts the following limitations of liability. We Buy All Gold and Silver’s liability and Customer’s total remedy is and shall be expressly and specifically limited to the LEAST of the following:

• The sum of $100 (One Hundred Dollars)
• The Liquidation value of the total contents received from the Customer as determined by We Buy All Gold and Silver’s sole discretion. In the event that Customer has proof that an appraisal of the contents of items that were submitted was sent to We Buy All Gold and Silver prior to shipping items, then an amount equal to 35% of such appraised value will apply.
• If no appraisal was issued prior to the contents being mailed to We Buy All Gold and Silver, then Customer expressly acknowledges and agrees that the liquidated value determined by We Buy All Gold and Silver shall be binding and conclusive and that We Buy All Gold and Silver’s liability shall in no event exceed $100.00 (One Hundred Dollars).
• We Buy All Gold and Silver will not be liable for any special, indirect, incidental, consequential, punitive damages, loss of profit or loss of opportunity. Customer agrees that this limitation of liability shall be binding to not only the customer, but also to his successors, assigns, insurance carriers any other person asserting a claim on any material customer submitted to We Buy All Gold and Silver. By submitting any property to We Buy All Gold and Silver, Customer waives any subrogation claim on his behalf and/or on behalf of his insurance carrier. Customer acknowledges and agrees that We Buy All Gold and Silver will not be liable to the Customer for any damages of any kind, including for the loss of your property or for any other reason, including any acts or omissions. We Buy All Gold and Silver’s total liability to the Customer will in no circumstances exceed $100.00

Waiting Period for Filing a Claim

In the event that there is a claim, customer may request from We Buy All Gold and Silver a Claim form at any time. Claim forms must be accurately completed and all supporting material must be provided and submitted after a 50 (Fifty) day waiting period from the time the We Buy All Gold and Silver Pack was submitted so that We Buy All Gold and Silver may have ample time to investigate any potential claims. Failure to submit a properly completed and signed Claim form with all of the required supporting documentation will constitute a waiver by the customer and will result in denial of your claim.

Returns - Liabilities and Procedures

When a Customer uses a We Buy All Gold and Silver Pack, Customer is offering merchandise for sale to We Buy All Gold and Silver and acknowledges, understands and agrees that they will be offered the fair market wholesale value for items they submitted. In the event that an item is returned to the customer for any reason, We Buy All Gold and Silver shall, at its own expense choose a carrier for the return and insure any item valued at $15, or more for twice the value as determined by We Buy All Gold and Silver sole discretion.

Customer may at his own expense purchase additional insurance, provided that notification and payment of additional insurance premium is received by We Buy All Gold and Silver prior to shipment. Except as expressed in this paragraph, We Buy All Gold and Silver will have no liability to Customer in connection with returns of any kind.

Acceptance of Oral and Written Offers

Once a Customer’s We Buy All Gold and Silver Pack is received by us a payment shall be issued within twenty four (24) hours. If for any reason a customer is dissatisfied with the amount they receive, simply return the check to We Buy All Gold and Silver within 10 days from the date the check was issued and your material will be returned to you. A $15.00 shipping and handling fee will apply to all material retuned to Customer.

If you do not return the check within the specified time, or if you deposit or cash the check then the items you submitted become the immediate property of We Buy All Gold and Silver.

Any Customer may ask We Buy All Gold and Silver to provide either an email or telephone quote for their items. When an offer is accepted by the Customer, a check for payment will issued within 24 hours and the all items submitted shall immediately become the property of We Buy All Gold and Silver and Customer understands that the ten (10) waiting period no longer applies.

If the Customer chooses a direct payment method other than the standard payment method described herein, then the 10 day waiting period shall no longer apply and all items submitted by Customer shall become the immediate property of We Buy All Gold and Silver. If you are dissatisfied with the amount of the check you receive, you may contact us by phone 888-GOLD-312 and notify us of your intention to return our check to us.

We will hold your items for return, provided that your return the check you received for payment within the specified time. Additional Fees will be subtracted from the amount you will receive for any items you submit to us for the following: Direct Deposits of funds into your account: $5 under for transfers under $250; free for amounts over $250. Next Day Delivery of your Payment Check.

Once your check is processed within 24 hours of receipt of your We Buy All Gold and Silver Pack, it will be sent to you next day delivery. Fee of $20 will be deducted from your payment Two Day Delivery of your Payment Check. Once your check is processed within 24 hours of receipt of your We Buy All Gold and Silver Pack, it will be sent to you two day delivery. Fee of $25 will be deducted from your payment.

Other Provisions

Customer acknowledges that this Agreement shall be governed by the local laws of the Commonwealth Pennsylvania without regard to its conflict of law principles. If any provision of these terms and conditions are found by a court of competent jurisdiction to be invalid, the court shall modify said provisions to effectuate the parties' intentions, and the other provisions set forth in these terms and conditions remain in full force and We Buy All Gold and Silver’s failure to exercise or enforce any right or provision under these terms and conditions will not be deemed to be a waiver of such right or provision.

The Customer agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to any transaction must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the Commonwealth of Pennsylvania.

Customer further agrees that We Buy All Gold and Silver shall be entitled to reimbursement for any and all costs incurred in order to defend any civil action filed or attempted to be filed in any jurisdiction outside of the Commonwealth of Pennsylvania, including but not limited to, attorney's fees incurred by We Buy All Gold and Silver.
